Terms and conditions

1. Method of ordering goods

  • The goods can be ordered in the form of an online order directly from the shopping cart.
  • Goods can also be ordered by phone at tel.: 420 601 262 600.
  • The goods can be ordered by e-mail: prodejna@agama-diving.cz
  • If the customer wants to apply a discount (discount code), enter it during the order or enter it in the notes. Discount codes are valid for consumers (retail) only, unless otherwise stated.
  • To cancel an order, please use the above contacts.

2. Confirmation of your order

  • Your order will be confirmed within 24 hours. You will also be informed when we ship the goods.

3. Delivery and postage

  • Postage is not included in the product price.
  • Postage for the Czech Republic: transport is provided by the companies Zásilkovna or GLS, which are usually able to deliver the goods within the next day (if ordered before 12:00 p.m.). This is the usual delivery time, but it is not guaranteed.
  • Postage to Slovakia: transport is provided by Zásilkovna and GLS, which delivers goods within 1-2 days.

4. Payment

  • Possibility of payment by cash on delivery, by card online or by transfer to a bank account in advance (FIO BANKA).
  • The billing information for entering the bank order will be sent by e-mail.
  • The goods are sent after the payment has been credited to the account.
  • We send goods to Slovakia both cash on delivery and by bank transfer in advance. The customer pays the carrier in EUR, which is determined by the exchange rate of the first working day of the month according to the CNB.

5. Checking the shipment

  • When you receive the package from the transport service employee, you have the right to check the package for mechanical damage. In the event of damage, you have the option to file a claim with the carrier in question.

6. Complaints, guarantee

  • In the event that you discover a defect on the purchased goods during the warranty period, which was not caused by improper use, but by the defect of the goods themselves, you have the right to claim within the warranty period.
  • Return the claimed goods, including all accessories, documents and a cover letter with a brief description of the defect, to our address: AGAMA, Vršava I 1492, 760 01 Zlín.
  • The complaint will be processed without delay; within 30 days at the latest.
  • Complaints are governed by the relevant legal regulations. We provide a 24-month warranty for goods ordered and purchased via the online store from the date of delivery, unless more is stated.
  • Our goal is to handle the complaint to your satisfaction.

7. Return of goods within 14 days without giving a reason

Return form

  • If the contracting party is a consumer, relations not regulated by business terms and conditions are governed by the Civil Code and the Consumer Protection Act.
  • If the purchase contract is concluded using means of distance communication, the consumer has the right to withdraw from the contract within 14 days of receiving the goods. In this case, the consumer contacts the seller and preferably states in writing that he withdraws from the contract, stating the order number, date of purchase and account number for the refund. Withdrawal from the contract must be sent no later than the last day of the 14-day period. The provisions of the Act on the possibility of returning goods cannot be understood as the possibility of free lending of goods!
  • According to § 1837 of the Civil Code, the right to withdraw from the contract within 14 days does not apply to sales contracts in which the goods were modified according to the customer's wishes or for his person (e.g. peace suits, modification of suits).
  • The costs associated with returning the goods are fully borne by the buyer.
  • If the consumer withdraws from the contract, the entrepreneur will return to him without undue delay, no later than fourteen days from the withdrawal from the contract, all funds, including delivery costs, which he received from him on the basis of the contract, in the same way. The entrepreneur will return the money received to the consumer in another way only if the consumer has agreed to it and if it does not incur additional costs.
  • The consumer is liable to the entrepreneur only for the reduction in the value of the goods, which occurred as a result of handling the goods in a different way than it is necessary to handle them with regard to their nature and characteristics.
  • When exchanging goods (e.g. for a different size), the seller charges a reduced shipping fee of CZK 50.

8. Further Arrangements

  • If the customer does not accept the shipment, it is not a withdrawal from the contract without giving a reason within the 14-day period, but he has grossly violated the obligation arising from the concluded purchase contract. In such a case, the seller is entitled to compensation for postage-related costs (Section 2118 et seq. of the Civil Code).
  • Information about customers is stored in accordance with the applicable laws of the Czech Republic, in particular with the Personal Data Protection Act No. 101/2000 Coll. as amended by later amendments and regulations. By concluding the contract, the buyer agrees to the processing and collection of his personal data in the seller's database after the successful completion of the contract, until the time of his written statement of disagreement with this processing.
  • Each issued gift voucher has a given expiry (expiration date), which is marked on the voucher. Upon expiration of the term, the consumer's right to redeem the voucher ceases.
  • In the event that a consumer dispute arises between us and the consumer arising from a purchase contract or a contract for the provision of services, which cannot be resolved by mutual agreement, the consumer can submit a proposal for an out-of-court settlement of such a dispute to the designated entity for out-of-court settlement of consumer disputes, which is: Czech Republic Trade Inspection, Central Inspectorate - ADR Department, Štěpánská 15, 120 00 Prague 2, E-mail: adr@coi.cz , Web: adr.coi.cz.
